SUBJECT MATTER
Parties agree that Subscriber accepts the obligation to pay monthly fee for the provision of internet bandwidth services in the period specified herein and establishes the subscription with SOLFORD TRADING LIMITED.
MONTHLY SUBSCRIPTION is a service paid by the subscriber for using software of NETTV PLUS browser + internet bandwidth from our servers to LQ, HQ or HD quality users.
LQ – is variable average bandwidth of 500 kb/s (available only for mobile phones)
HQ – is variable average bandwidth of 1000 kb/s
HD – is variable average bandwidth of 2500 kb/s
Subscriber shall be any physical or legal entity that enters this Agreement with SOLFORD TRADING LIMITED and that uses mentioned service for own, non-commercial purposes. By signing this Agreement, the subscriber represents, under the penalty of perjury, not to use mentioned service for commercial purposes, not to copy or infringe copyright or any related rights, and in case that Subscriber has found out that such a cts have been committed by third parties, to immediately inform the SOLFORD TRADING LIMITED about that.
SUBSCRIPTION FEE
Subscription fee for using software NETTV PLUS browser + internet bandwidth from our servers to user in LQ, HQ or HD quality shall be paid by Subscriber at the pricelist defined by SOLFORD TRADING LIMITED.
SOLFORD TRADING LIMITED is entitled to change the content s of the program package during the term of this Agreement, the amount of subscription fee, the subscription period, as well as other terms and conditions.
The Subscriber agrees that SOLFORD TRADING LIMITED shall inform him/her about such changes upon renewal of the subscription period.
The payment of the subscription fee shall be made in accordance with the instructions of SOLFORD TRADING LIMITED.
The payment of the subscription fee shall be made at prices valid at the payment date, in advance, for a period of 3, 6 or 12 months, and for 1 month only in case that Subscriber can instruct his/her bank to pay the subscription on monthly basis (standing order).
TERM
This Agreement is concluded for a period of 24 months. The Subscriber shall be entitled to terminate the Agreement within 7 days. Upon the expiry of this Agreement, the Subscriber can sign new agreement.
If Subscriber fails to notify SOLFORD TRADING LIMITED in writing not later than 7 days prior to expiry of signed agreement, of Subscriber’s intention not to extend this Agreement, this Agreement shall be deemed extended for additional period of 24 months.
SUBSCRIPTION CANCELLATION
SOLFORD TRADING LIMITED is authorized to cancel provision of services to Subscriber if Subscriber fails to pay subscription fee in accordance with this Agreement. This service shall be cancelled upon expiry of the subscription period if Subscriber fail s to renew it.
The Subscriber shall pay the subscription fee for 3, 6, 12 or 24 months, at his/her option. In case Subscriber pays the subscription fee for 3, 6 or 12 months, the Subscriber shall be obliged to renew the subscription period within 5 days from the expiry of the selected subscription.
In case Subscriber stops paying the subscription fee, upon expiry of 30 days, Subscriber shall pay contractual penalty. In this case, the Subscriber shall not be entitled to reactivation.
LIMITATION OF LIABILITY
SOLFORD TRADING LIMITED shall not be liable for: any change, disturbance, definitive and temporary disconnection, or any delay in searching multimedia content: TV channels, RADIO channels, daily newspapers, movies, games (this multimedia content is broadcasted by other companies, while Net TV browser searches and sorts the addresses for users).
SOLFORD TRADING LIMITED shall not be liable with respect to any difficulties in receiving signal arising out of place and conditions of receiving the signal or inadequate equipment at Subscriber’s, bad installations, malfunctioning, unauthorized service of purchased equipment or inadequate use of the equipment by the Subscriber.
SOLFORD TRADING LIMITED shall not be liable in case of any delay or failure to perform obligations under this Agreement arising out of force majeure events, omissions or accident s beyond reasonable control including, but not limited to fire, flood, storm, destruction of goods which SOLFORD TRADING LIMITED could not prevent, war (declared or threatened), state of emergency, conflict, act of terrorism, riot, civil war, lockout, embargo, government act, any change, interruption or suspension of activity caused by administrative, court or legal deed applicable to SOLFORD TRADIMG LIMITED, sabotage, strike, natural disaster, walkout, danger, power supply failure, quarantine, contamination, external transmission effects, and simil ar. In case force majeure event is exceeding period of 30 days, either party shall be entitled to terminate this Agreement for convenience.
SOLFORD TRADING LIMITED shall not be liable with respect to contents of the program broadcasted within the program package.
SOLFORD TRADING LIMITED gives no warrantees to the Subscriber as to the fact that owner of the program shall not stop broadcasting the program.
USERS’ INFORMATION
SOLFORD TRADING LIMITED is authorized to collect, file and use any information about subscribers (first and last name, address, PO Box, telephone number, etc.) as well as other information he receives upon conclusion or during the term of this Agreement, to the extent it is necessary for the performance of this Agreement.
By signing subscription agreement, the Subscriber agrees that SOLFORD TRADING LIMITED can disclose subscription information to the owner of the program for the purpose of his market research and records keeping.
SOLFORD TRADING LIMITED shall reserve the right to carry out surveys regarding quality of service with his subscribers. By signing this Agreement, the Subscriber agrees that in case he/she fails to perform obligations to SOLFORD TRADING LIMITED under this Agreement, Subscriber’s information can be made available to third parties.
GENERAL TERMS AND CONDITIONS
- SOLFORD TRADING LIMITED gives no warranty to subscriber as to the existence or quality of any multimedia content searched on the internet;
- SOLFORD TRADING LIMITED gives no warranty as to the internet connection of the subscriber who is obliged to provide minimum internet connection with local providers of 500 kb/s;
- Subscriber is obliged to check his/her internet connection as well as internet speed in order to use the browser services without any disruptions;
- SOLFORD TRADING LIMITED undertakes to provide test connection for 2 days, free of charge, before signing this Agreement.
OTHER RIGHTS AND OBLIGATIONS
SOLFORD TRADING LIMITED is entitled to transfer any rights and obligations or part thereof to third parties, at any time, and Subscriber has agreed to it.
Subscriber shall not, without explicit consent of SOLFORD TRADING LIMITED in writing, transfer any of its subscription rights hereunder to t hird party. The subscriber is not allowed to resale or subcontract the service. By signing this Agreement the subscriber fully confirms the accuracy of data provided herein.
This Agreement is made in two exact copies of which each party shall retain one copy.
The user has read the Agreement and agrees to provisions stated herein.
